1. Introduction to TheSwissDeal

TheSwissDeal is a web and mobile platform allowing users to publish, browse, search and manage local listings in Switzerland.

The platform is accessible through:

• the website https://theswissdeal.ch;
• the iOS mobile application;
• the Android mobile application.

TheSwissDeal allows users to publish listings relating to the sale, donation, rental or promotion of goods and services, subject to compliance with these Terms of Use.

User support is available through the “Support” module on the website or in the application.

Using TheSwissDeal means accepting these Terms of Use in full.

2. Account creation and management

Some features of TheSwissDeal are available without an account, including browsing listings. Creating an account is required to publish listings, contact users, manage favourites, use messaging or access advanced features.

Required information

When creating an account, the user may be required to provide:

• a valid e-mail address;
• a password;
• first name;
• last name;
• a Swiss phone number;
• an optional profile picture;
• a preferred language.

The user must provide accurate, complete and up-to-date information.

Account verification

TheSwissDeal may require e-mail and/or phone verification. Certain features, including publishing listings or contacting users, may be limited until the account is completed or verified.

Incomplete account

An account may be considered incomplete if required information is missing. In that case, TheSwissDeal may redirect the user to the appropriate step to complete the profile.

Account deletion

The user may request account deletion from account settings or through support. Deletion results in erasure or anonymisation of associated data, subject to legal retention obligations, including accounting, security, abuse prevention or disputes.

3. How the platform works

TheSwissDeal allows users to publish, browse, search and manage local listings in Switzerland.

Browsing listings

Listings can be browsed by everyone. Some advanced features, such as favourites, messaging, publishing or listing management, may require a logged-in account.

Publishing listings

To publish a listing, the user must have a valid account and comply with the applicable posting rules.

TheSwissDeal may require:

• a completed account;
• a verified e-mail address;
• a verified phone number;
• compliance with category-specific rules;
• accurate information about the item or service offered.

Each listing must comply with Swiss law and these Terms of Use.

Listing duration

Listings may be published for a limited duration. TheSwissDeal may deactivate, archive, delete or limit visibility of a listing when its validity expires, in case of inactivity or in case of rule violations.

Service changes

TheSwissDeal may update its features, categories, paid options, posting rules or web/mobile interfaces to improve the service, security or legal compliance.

4. Messaging and user behaviour

TheSwissDeal provides an internal messaging system allowing users to communicate about a listing without publicly displaying their personal contact details.

Behaviour rules

Users must use messaging respectfully and honestly. The following are prohibited:

• insults, threats, discriminatory or hateful content;
• fraudulent, misleading or illegal content;
• scam attempts;
• suspicious or out-of-context payment requests;
• harassment or unsolicited commercial prospecting;
• mass or automated messages.

Responsibility for exchanges

TheSwissDeal acts as a technical intermediary. Exchanges, agreements, sales, purchases, rentals or meetings between users are the responsibility of the users involved.

TheSwissDeal is not a party to transactions between users, except where a paid service is directly provided by TheSwissDeal.

Reporting and blocking

Users may report inappropriate content, listings or behaviour. TheSwissDeal may review reports and take necessary measures, including warnings, account limitations, content deletion or suspension.

5. Payments, boosts and paid options

TheSwissDeal may offer paid services, including visibility boosts, editing options, professional publication options or other paid features.

Paid options

Available paid options, prices, durations and effects are those displayed on the platform at the time of order.

These options may include:

• listing highlights;
• listing bumps;
• premium visibility;
• fees related to certain edits or publications;
• options reserved for professional accounts.

TheSwissDeal may change its prices, offers and paid options at any time. Changes do not apply retroactively to orders already confirmed.

Payment

Payments are processed by Mollie, a secure external payment provider.

TheSwissDeal does not store full banking data. Payment information is processed by the payment provider according to its own security and compliance rules.

Activation

Unless otherwise stated, paid options are activated after payment confirmation. Technical delays may occur.

No guarantee of results

Buying a paid option may increase or modify visibility according to the displayed terms, but does not guarantee any number of views, messages, sales, contacts or commercial results.

Refunds

Except in case of proven technical error attributable to TheSwissDeal or mandatory legal requirement, immediately activated digital options are not refundable.

6. Usage rules and listing moderation

Users must publish only accurate, lawful, complete listings that comply with these Terms of Use.

Prohibited content

The following are prohibited:

• content contrary to Swiss law;
• defamatory, abusive, hateful, violent or discriminatory content;
• misleading, fraudulent or false content;
• listings infringing third-party rights;
• counterfeit goods;
• weapons, dangerous products, medicines, illegal substances or regulated goods without authorisation;
• illegal or immoral services;
• listings designed to bypass platform rules;
• mass, automated or unauthorised commercial prospecting.

Sensitive categories

Certain categories may be limited, controlled or prohibited. TheSwissDeal may impose specific rules for certain listings, including animals, vehicles, regulated goods, services, real estate or professional activities.

The user is solely responsible for ensuring that their listing complies with applicable law.

Moderation

TheSwissDeal may perform automatic or manual moderation.

TheSwissDeal reserves the right to:

• refuse a listing before publication;
• change the visibility of a listing;
• delete a listing;
• suspend or limit an account;
• request additional information;
• refuse a refund if the listing violates rules.

TheSwissDeal is not required to provide detailed justification for each measure in case of clear violation or platform risk.

7. Personal data protection

TheSwissDeal processes personal data in accordance with Swiss data protection law, including the nFADP, and, where applicable, the GDPR.

Details about data processing are provided in the Privacy Policy available on the platform.

TheSwissDeal may process:

• account information;
• listing information;
• messages and reports required for security;
• technical data;
• limited payment data;
• documents required for professional verification.

Purposes

These data are used to:

• create and manage accounts;
• allow listing publication and search;
• provide messaging;
• process payments;

• ensure security;
• prevent abuse;
• comply with legal obligations.

User rights

Users may request access, correction, deletion or restriction of their data, within the limits provided by law.

Requests can be made through account features or support.

8. Notifications, advertising and activity tracking

TheSwissDeal may send notifications to inform users about important events related to their account, listings, messages, payments or platform security.

Notifications

Notifications may include:

• new messages;
• activity around a listing;
• activation or end of a paid option;
• security reminders;
• important platform information.

Users can manage notification preferences from their account, the application or device settings.

Advertising and analytics

TheSwissDeal may use advertising, analytics or audience measurement services on the web or in mobile applications, in compliance with applicable rules.

Where consent is required, TheSwissDeal implements appropriate mechanisms.

Technical data

Technical data may be used to improve stability, security, performance and user experience. This may include device type, browser, operating system, technical errors or usage events.

9. Intellectual property

Rights over TheSwissDeal

All elements composing TheSwissDeal, including texts, trademarks, logos, icons, interfaces, graphics, images, sounds, software, databases, architecture and features, are protected by intellectual property law.

Unless otherwise stated, these elements belong to Musliu Projects or its partners/licensors.

Any unauthorised reproduction, extraction, modification, publication, transmission, exploitation or reuse is prohibited.

User-published content

Users retain rights over the content they publish, including listing texts, images and descriptions.

By publishing content on TheSwissDeal, the user grants Musliu Projects a non-exclusive, free, worldwide licence limited to what is necessary to:

• host the content;
• display it on the platform;
• technically reproduce it;
• distribute it as part of the normal operation of TheSwissDeal;
• promote the listing or the platform within reasonable limits of the service.

The user guarantees that they hold the necessary rights to the published content.

10. Liability and limitations

TheSwissDeal provides a local listing and connection service. Except for paid services directly provided by TheSwissDeal, the platform is not a party to transactions between users.

User responsibility

Each user is responsible for:

• the information they publish;
• the content they transmit;
• the goods or services they offer;
• compliance with applicable law;
• exchanges with other users;
• verifying information before any transaction.

Service availability

TheSwissDeal makes reasonable efforts to ensure platform availability, but does not guarantee uninterrupted, error-free or incident-free access.

TheSwissDeal may temporarily suspend access for maintenance, security, updates or force majeure.

Limitation

To the extent permitted by law, TheSwissDeal is not liable for indirect losses, loss of opportunity, commercial losses, disputes between users, fraud committed by third parties or damage resulting from misuse of the service.

11. Applicable law and jurisdiction

These Terms of Use are governed by Swiss law.

Subject to mandatory legal provisions, any dispute relating to the use of TheSwissDeal falls under the jurisdiction of the courts of the canton of Vaud, Switzerland.

Before any proceedings, the parties will try, where possible, to seek an amicable solution.

12. Changes to the Terms and acceptance

TheSwissDeal may amend these Terms of Use at any time to reflect changes in the service, legislation, features, payment methods, security rules or operational needs.

Users may be informed of important changes by any appropriate means, including notification, e-mail, publication on the website or message in the application.

Continued use of TheSwissDeal after the Terms are updated constitutes acceptance of the new terms.

If the user refuses the new terms, they must stop using the platform and may request deletion of their account.

13. Professional accounts and verification

TheSwissDeal may offer professional accounts.

Creating or activating a professional account may require additional information, including:

• company name;
• UID/IDE number;
• identity of the legal representative;
• identity verification documents;
• company or UID/IDE verification documents.

The user guarantees that all information and documents provided are accurate, up to date and lawful.

TheSwissDeal may manually review the documents and accept, refuse, suspend or remove professional status in case of inaccurate information, suspected abuse, legal risk or violation of platform rules.

Verified professional status does not constitute a guarantee by TheSwissDeal regarding the quality, solvency, reliability or commercial behaviour of the professional user.
